House of Kalakar

These Terms explain the conditions that apply when you use our website, place an order or access our services.

Last updated: 5 August 2026

Australian Consumer Law

Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or limits any rights or remedies you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Clear Order Confirmation Your order is accepted when we confirm it or send a dispatch confirmation.
One-of-One & Limited Stock Many designs are unique or available in very limited quantities.
Consumer Rights Protected These Terms operate alongside your rights under Australian law.

Terms of Service

Acceptance of These Terms

These Terms apply to your use of houseofkalakar.com.au, purchases made through our website and, where relevant, services provided through boutique or virtual appointments.

By using our website, creating an account, booking a service or placing an order, you agree to these Terms and the policies linked within them.

If you are under 18, you must use the website and place orders only with the involvement and consent of a parent or legal guardian.

About House of Kalakar

In these Terms, “House of Kalakar”, “we”, “us” and “our” refer to the House of Kalakar business based in Melbourne, Victoria, Australia.

“Website” means our online store and associated webpages. “Products” and “services” include garments, accessories, styling, appointments, tailoring and other offerings made available by us.

Using Our Website

You must not use the website to:

  • Break any applicable law or infringe another person’s rights.
  • Attempt to gain unauthorised access to the website, customer accounts or connected systems.
  • Introduce viruses, malicious code or other harmful technology.
  • Scrape, copy, reproduce or commercially exploit website content without our written permission.
  • Interfere with the website’s operation, security or availability.
  • Submit false, misleading, fraudulent or abusive information.

We may restrict access where reasonably necessary to protect customers, our business, our systems or the website.

Product Information and Visual Representation

We take reasonable care to present product descriptions, prices, sizing information and availability accurately. However, colours may appear differently because of lighting, photography and screen settings.

Many products are handmade or individually finished. Small variations in embroidery, beadwork, placement, colour, fabric and finish may form part of the product’s individual character and are not necessarily defects.

Some lifestyle or model images may be styled, digitally enhanced or AI-assisted for visual presentation where indicated. Please review the product detail images, written description, measurements and list of included components before ordering.

If a product is materially different from its description, your rights are governed by our Returns Policy and the Australian Consumer Law.

Pricing, Availability and Errors

Prices are displayed in the currency selected on the website or shown at checkout. Taxes, shipping charges, duties and other applicable costs are displayed or described before payment where reasonably possible.

Product availability may change without notice, particularly for one-of-one and limited-stock pieces. Adding an item to your cart does not reserve it.

We may correct genuine typographical, pricing, technical or availability errors. If an error affects an order you have placed, we will contact you and offer an appropriate option, which may include confirming the corrected order or cancelling it for a full refund.

Orders and Acceptance

Placing an order is an offer to purchase the selected products. An automated order acknowledgement does not necessarily mean the order has been accepted.

Your order is accepted when we expressly confirm acceptance or send a dispatch confirmation.

Before dispatch, we may decline or cancel an order on reasonable grounds, including:

  • The product is unavailable or was sold through another channel.
  • There is a genuine pricing or listing error.
  • Payment is declined, reversed or cannot be verified.
  • We reasonably suspect fraud, unauthorised payment or misuse.
  • We cannot deliver to the supplied address or destination.
  • We are otherwise unable to fulfil the order.

If we cancel an order after payment, we will notify you and refund the amount paid for the cancelled item or order.

Payment

You agree to pay the total amount shown at checkout using an available payment method. You confirm that you are authorised to use the selected payment method and that the information supplied is accurate.

Payment services may be provided by third-party processors and may be subject to their terms and privacy practices. We do not store full payment-card details where they are processed directly by an external payment provider.

Discounts, Promotions and Store Credit

Discount codes, promotions, gift offers and store credits are subject to the conditions communicated with the offer. Unless expressly stated otherwise, offers cannot be combined, exchanged for cash or applied retrospectively.

We may correct or cancel a promotion where there is a genuine error, misuse or fraud, provided this does not limit any rights you have under applicable law.

Sizing, Tailoring and Alterations

Size guides and fit recommendations are provided to assist your selection. Fit can vary depending on the design, cut, fabric, construction and personal preference.

Where tailoring, alterations or customisation are requested, you are responsible for providing accurate measurements and checking the agreed alteration details. Additional timeframes and charges may apply.

Tailored, altered or customised products are subject to the conditions in our Returns Policy. Nothing in this section limits rights that apply where a product or service fails to meet a consumer guarantee.

Shipping and Delivery

Dispatch estimates, delivery timeframes, tracking, customs charges and destination conditions are set out in our Shipping Policy.

Ready-to-ship orders are generally dispatched within one business day after payment is confirmed. Tailored, altered, customised or pre-order products may require additional processing time.

We remain responsible for assisting with parcels that are missing, damaged or incorrectly supplied where required by law.

Returns, Exchanges and Consumer Guarantees

Voluntary change-of-mind exchanges and store credits are governed by our Returns Policy.

Consumer-guarantee rights for faulty, damaged, incorrectly supplied or materially misdescribed products are separate from voluntary return conditions and cannot be removed by these Terms.

Appointments and Boutique Services

Appointment availability is subject to confirmation. Please arrive on time and notify us as soon as possible if you need to reschedule or cancel.

Styling guidance is based on the information and preferences provided to us. Final product and size selection remains the customer’s decision unless otherwise agreed in writing.

Intellectual Property

The website and its content—including branding, logos, text, graphics, photographs, videos, layouts and original designs—are owned by or licensed to House of Kalakar and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes. You must not reproduce, adapt, publish, distribute, sell or commercially use our content without prior written permission.

Customer Reviews, Photos and Other Content

Content you submit must be genuine, lawful, respectful and based on your own experience. You must have permission to share any photograph, video, name or other material you provide.

We may moderate or remove content that is unlawful, fraudulent, misleading, abusive, infringing or unrelated. We will not edit a genuine review in a way that changes its meaning.

We will only reuse identifiable customer photos or videos for marketing where permission has been given or the conditions of submission clearly allow that use.

Privacy

We handle personal information in accordance with our Privacy Policy.

Our Privacy Policy explains the types of information we collect, why we collect it, how it may be used or disclosed, and how to contact us about privacy matters.

Third-Party Services and Links

The website may use or link to third-party services, including payment processors, appointment platforms, social networks and delivery providers.

Those services may have their own terms and privacy policies. We are not responsible for third-party websites that we do not operate, except to the extent responsibility cannot lawfully be excluded.

Website Availability

We aim to keep the website available and secure, but access may occasionally be interrupted for maintenance, updates, technical issues or events outside our reasonable control.

We may update, suspend or discontinue website features where reasonably necessary. These changes do not affect an order already accepted unless we contact you and provide an appropriate resolution.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, we are not responsible for loss caused by your misuse of a product, failure to follow care instructions, unauthorised use of the website or inaccurate information supplied by you.

Any limitations in these Terms apply only to the maximum extent permitted by law and do not restrict your rights under the Australian Consumer Law.

Changes to These Terms

We may update these Terms to reflect changes to our website, products, services, business practices or legal obligations. The updated version will be published on this page with a revised date.

The Terms applying to a purchase are generally those in effect when the order is placed. We will not apply material changes retrospectively to an accepted order unless required by law or agreed with you.

Governing Law and Disputes

These Terms are governed by the laws of Victoria and the Commonwealth of Australia.

Please contact us first so we can attempt to resolve any concern. If a dispute cannot be resolved, it may be dealt with by a court or tribunal with jurisdiction. Nothing in this section prevents you from exercising any right to bring a claim in another jurisdiction where applicable law permits.
